Top Wighay Farm in Hucknall

BWB were appointed by the owners of op Wighay Farm, Hucknall to provide expert witness services related to flood risk and drainage to help promote the site for inclusion in the emerging Local Plan.

A review undertaken of our Client's site and all competing allocations identified that the sequential test recommendations of PPG25 were not being followed in the Local Plan review process.

Technical work was produced to demonstrate the favourable nature of the Top Wighay Farm site in terms of flood risk and drainage, and objections were lodged relating to competing allocations in higher risk areas. This led to Expert Witness evidence being submitted to support the competing allocations and BWB undertook a critical review of that evidence on behalf of our Client.

It was concluded that the planning arguments based around the content and interpretation of PPG25 represented the strongest planning case in favour of our Client's site. Expert Witness evidence to support and justify this position was prepared and presented to the Inquiry by BWB, and substantiated under intensive cross examination.

The evidence presented was cited in the Inspector's report as significant in leading him to recommend withdrawal of the competing site and inclusion of our Client's site in the Local Plan. The revised deposit draft plan is expected shortly.
